Краткая справка

Статья 159 УК РФ описывает мошенничество как хищение чужого имущества или приобретение права на него путём обмана или злоупотребления доверием․ В зависимости от обстоятельств предусмотрены части 1-4, а также специализированные составы 159․1-159․6․

Article 159․ Fraud

1. Fraud, that is, the stealing of another person’s property or the acquisition of the right to another person’s property by deception or abuse of confidence, shall be punishable by a fine of up to one hundred and twenty thousand roubles, or in the amount of the convicted person’s wages or other income for a period of up to one year, or by compulsory labour for up to three hundred and sixty hours, or by corrective labour for up to one year, or by restriction of liberty for up to two years, or by forced labour for up to two years, or by deprivation of liberty for the same period․
2. The same act committed:
   • by a group of persons in a preliminary conspiracy;
   • repeatedly;
   • with a significant amount of damage;

   shall be punishable by a fine of from one hundred thousand to five hundred thousand roubles, or in the amount of the convicted person’s wages or other income for a period of one to three years, or by forced labour for up to five years with or without restriction of liberty for up to one year, or by deprivation of liberty for up to five years with or without a fine of up to eighty thousand roubles․

3. Acts specified in part one of this Article, committed by an organised group, or on a large scale, shall be punishable by deprivation of liberty for a term of up to six years with or without a fine of up to five hundred thousand roubles․
4. Acts specified in part one of this Article, committed on an especially large scale, or by a person using his official position, shall be punishable by deprivation of liberty for a term of up to ten years with or without a fine of up to one million roubles․

3. Не переводите «штраф» как penalty в контексте уголовного права: корректно fine․
4. Различайте deprivation of liberty (лишение свободы) и imprisonment, хотя в быту они синонимичны․
